Misti, make sure that the person who applied the chemical had a pesticide's license. If the company was using untrained, unlicensed personnel, it will further your case.

Also, did they spray your vegetable garden? If so, "damages" would include the cost of buying instead of growing organic vegetables.

I would start talking to attorneys right away. The first consult is typically free. It may take time to find one who you feel comfortable with. Perhaps, the local university, environmental club or other group could recommend a like minded attorney.

What a terrible problem. I feel for you!
